Selling the family home after a separation.

A clean break needs a certain figure on a certain date. Here is how a fast sale fits, what has to be agreed first, and where to get the legal side right.

Agree the principle first

Both owners have to sign. If one of you wants to sell and the other does not, a cash buyer cannot help until that is resolved, by agreement, mediation or the court as part of a financial order. Do not agree a sale with anyone until both signatures are certain.

Why speed helps

Every month the house stays unsold is another month of a joint mortgage, joint bills and joint decisions between people who would rather not be making them. A cash sale gives a fixed figure to put into the financial settlement, a date everyone can plan around, and no chain to collapse and reopen the whole thing.

Why it might not be the answer

If you have time and can bear the process, the family home is usually the biggest asset in the settlement, and 15% to 25% of it is a lot to give up. If one of you wants to buy the other out, a remortgage or a valuation is the route, not a sale. A solicitor or mediator should look at the whole picture before the house goes anywhere.

Practicalities

  • Get a written offer both of you can see. It stops arguments about whether the figure is fair.
  • The buyer can deal with one of you as the point of contact if you prefer, with the other copied in through the solicitor.
  • If one of you has already moved out, an empty or half-empty house is fine; cash buyers do not need it presented.
  • The proceeds go to your joint solicitor or to each of you as the settlement says, not to whoever asks first.

Can one owner sell without the other?

No. Both registered owners must sign. If one refuses, the court can order a sale as part of the financial settlement, but that takes time.
